從3月(yue)15日(ri)至5月(yue)15日(ri)期間,北京(jing)開展工(gong)時和(he)休息(xi)休假權益(yi)維護(hu)集中(zhong)排查整(zheng)治,聚(ju)焦重點行(xing)業(ye)(ye)企業(ye)(ye),集中(zhong)排查整(zheng)治超時加班問題,依法保(bao)障(zhang)職工(gong)工(gong)時和(he)休息(xi)休假權益(yi),營造(zao)和(he)諧的(de)勞(lao)動關系。

今天,北京市人(ren)力資源和社(she)會(hui)保障局發(fa)(fa)布(bu)《關于進一步做好工時和休(xiu)息休(xiu)假權(quan)益維護工作(zuo)的通知》根據通知,本(ben)次集中排查整治的檢查對象主要是(shi)超時加(jia)班問(wen)題易發(fa)(fa)多發(fa)(fa)的重(zhong)(zhong)點行業(ye)(ye),重(zhong)(zhong)點企(qi)業(ye)(ye),重(zhong)(zhong)點園區,重(zhong)(zhong)點突出互聯網企(qi)業(ye)(ye)及關聯企(qi)業(ye)(ye),研發(fa)(fa)崗(gang)位占比(bi)較高的技(ji)術密集型(xing)企(qi)業(ye)(ye),勞動(dong)密集型(xing)加(jia)工制造業(ye)(ye)企(qi)業(ye)(ye)和服務業(ye)(ye)企(qi)業(ye)(ye)
集(ji)中排(pai)查整(zheng)治內(nei)容主(zhu)要包括(kuo)五(wu)個方面(mian):用(yong)人(ren)單(dan)位(wei)制(zhi)定工(gong)(gong)時,休(xiu)息休(xiu)假內(nei)部規章制(zhi)度(du)情(qing)(qing)(qing)(qing)況(kuang)(kuang),用(yong)人(ren)單(dan)位(wei)實行(xing)特殊工(gong)(gong)時制(zhi)度(du)情(qing)(qing)(qing)(qing)況(kuang)(kuang),用(yong)人(ren)單(dan)位(wei)安排(pai)加班情(qing)(qing)(qing)(qing)況(kuang)(kuang)以及依法與工(gong)(gong)會和勞動者協商情(qing)(qing)(qing)(qing)況(kuang)(kuang),用(yong)人(ren)單(dan)位(wei)落(luo)實職工(gong)(gong)休(xiu)息休(xiu)假制(zhi)度(du)情(qing)(qing)(qing)(qing)況(kuang)(kuang),用(yong)人(ren)單(dan)位(wei)支付加班費,未休(xiu)年休(xiu)假工(gong)(gong)資報酬情(qing)(qing)(qing)(qing)況(kuang)(kuang)等。
在排查(cha)整(zheng)治(zhi)行動中,將(jiang)(jiang)通過北京(jing)人(ren)社系列(lie)政務新媒(mei)體等平(ping)臺發布工(gong)時和休(xiu)息休(xiu)假政策問答全市各區還將(jiang)(jiang)結合實際(ji),深入重點(dian)企業(ye)和工(gong)業(ye)園區,普及工(gong)時和休(xiu)息休(xiu)假法律規定,有針對(dui)性地開(kai)展政策解讀,督(du)促企業(ye)強化(hua)勞動法治(zhi)觀念(nian),引(yin)導勞動者正(zheng)確(que)理解相關法律規定,形成和擴大社會共識
例如,在工(gong)(gong)時方面,國(guo)家(jia)實行勞(lao)動(dong)(dong)者(zhe)(zhe)每(mei)日(ri)工(gong)(gong)作(zuo)時間不(bu)(bu)超(chao)過八小(xiao)時,平均每(mei)周工(gong)(gong)作(zuo)時間不(bu)(bu)超(chao)過四十小(xiao)時的(de)工(gong)(gong)時制度(du),用(yong)人單位應當保(bao)證勞(lao)動(dong)(dong)者(zhe)(zhe)每(mei)周至少休息一日(ri)如果存(cun)在安(an)排勞(lao)動(dong)(dong)者(zhe)(zhe)延長工(gong)(gong)作(zuo)時間,休息日(ri)安(an)排勞(lao)動(dong)(dong)者(zhe)(zhe)工(gong)(gong)作(zuo)又(you)不(bu)(bu)能(neng)安(an)排補休,或(huo)者(zhe)(zhe)法(fa)定休假日(ri)安(an)排勞(lao)動(dong)(dong)者(zhe)(zhe)工(gong)(gong)作(zuo)的(de)這些情形,用(yong)人單位應當按照相(xiang)關標(biao)準,支(zhi)付高(gao)于(yu)勞(lao)動(dong)(dong)者(zhe)(zhe)正常工(gong)(gong)作(zuo)時間工(gong)(gong)資的(de)工(gong)(gong)資報酬
在休(xiu)(xiu)(xiu)息休(xiu)(xiu)(xiu)假方面,在機(ji)關,團體(ti)(ti),企業(ye),事業(ye)單(dan)(dan)位(wei),民(min)辦非企業(ye)單(dan)(dan)位(wei),有雇(gu)工(gong)(gong)的(de)(de)個體(ti)(ti)工(gong)(gong)商戶等單(dan)(dan)位(wei)工(gong)(gong)作的(de)(de)職工(gong)(gong),只(zhi)要(yao)連續工(gong)(gong)作1年(nian)(nian)以上就可以享(xiang)受帶薪年(nian)(nian)休(xiu)(xiu)(xiu)假根據累(lei)計(ji)工(gong)(gong)作年(nian)(nian)限(xian),職工(gong)(gong)可享(xiang)受不(bu)同天(tian)數的(de)(de)年(nian)(nian)休(xiu)(xiu)(xiu)假,且國家法定休(xiu)(xiu)(xiu)假日(ri),休(xiu)(xiu)(xiu)息日(ri)不(bu)計(ji)入年(nian)(nian)休(xiu)(xiu)(xiu)假的(de)(de)假期(qi)對職工(gong)(gong)應休(xiu)(xiu)(xiu)未(wei)休(xiu)(xiu)(xiu)的(de)(de)年(nian)(nian)休(xiu)(xiu)(xiu)假天(tian)數,單(dan)(dan)位(wei)應當按照職工(gong)(gong)日(ri)工(gong)(gong)資收入的(de)(de)300%支付年(nian)(nian)休(xiu)(xiu)(xiu)假工(gong)(gong)資報酬(chou)
北京市人(ren)力資(zi)(zi)源和(he)社(she)會保障局指出,在(zai)本次(ci)集中排查中,如果發(fa)現用人(ren)單位有相關(guan)違法行為(wei),人(ren)力資(zi)(zi)源社(she)會保障部門將依法予以行政處理處罰并(bing)督促限(xian)期(qi)整改(gai),嚴防類似(si)問題發(fa)生。
